La prueba en el delito de instigación al suicidio Ecuador

Abstract

The objective of this investigation was toestablish the Ecuadorian legal frameworkregarding the crime of instigation to suicide inEcuador, which highlights the problems ofinvestigating suicide cases and the limitedapplicability of the rules established in theCode. Organic Comprehensive Criminal COIP,the cases are in the preliminary investigationstage. In the methodology, deductive andanalytical methods were applied, with adescriptive approach. The technique used wasthe bibliographic review and the review of theresults of the news of the crime committed byinstigation to suicide in the province of Guayasbetween January 1, 2021 and December 31,2023. The results identified four cantons thatThere were cases of suicide, with four cases inthe Guayaquil canton, one case in Daule, twocases in the Milagro canton, and one case inSimón Bolívar. The statistical reviewestablished seven completed cases and one casewas a suicide attempt. Among the conclusions,it was identified that it is necessary tostreamline the processes in order for them toadvance from the previous investigation stage.Keywords: Criminal offense, COIP, instigation,suicide, prior investigation
