CURRENT ISSUES OF THE LEGAL FRAMEWORK ON SAFETY AND WORK ACCIDENTS IN THE ECUADORIAN STATE

The right to work, codified in various international legislation and regulatory frameworks, is considered a fundamental human right (DeLaet & Cramer, 2020). In consideration of this, this research aims to analyze the Ecuadorian legal framework in relation to the protection of pregnant and breastfeeding women in the workplace. This communication adopts a qualitative methodological approach, focused on an exhaustive and rigorous documentary study. Data collection was carried out through a meticulous bibliographic review, focusing on documentary sources such as laws, government reports, previous studies, academic texts, institutional reports, yearbooks, journalistic articles and cartographic material. Furthermore, the research is characterized by using a descriptive method. Criteria for selecting documentary sources were designed, thus guaranteeing the quality and relevance of the information analyzed. Among the results, it stands out that: Pregnant women in the workplace face unique vulnerabilities, which justifies the existence of special protections. The need to protect mothers before and after childbirth is recognized, ensuring paid leave or social security benefits (Buitrago Escobar, 2014). Similarly, the Convention on the Elimination of All Forms of Discrimination against Women prohibits dismissal on the grounds of pregnancy or maternity leave. It is concluded that the study highlights the crucial importance of continuous monitoring and evaluation of existing policies. The need for periodic adjustments is suggested to ensure that regulations remain aligned with changing work realities and the specific needs of workers.
