HEALTHY CRITICISM IN THE ASSESSMENT OF TESTIMONIAL EVIDENCE IN NON-CRIMINAL PROCEEDINGS

The objective of the research is the analysis of the importance and incidence of the application of sound criticism in the assessment of testimonial evidence in the Ecuadorian legal framework. The problem presented by this type of evidence is its connection to the fear that the declarants are trying to deceive the judge, hence the duty to tell the truth manages to appear as the main burden that manages to be imposed on the witnesses. The veracity of the witnesses has been only one of the aspects to which the Judge must pay attention to correctly weigh their sayings, to these testimonies the Judge must apply the valuation of them, for this he has to refer to the valuation systems. The methodology used is the documentary design, an analytical contribution was made of the two study variables, in order to identify and describe the rules of sound criticism and their application in the testimonies. As a result, healthy criticism affects the assessment of testimonial evidence positively when an adequate assessment is made and negatively when there are witnesses who testify, without being considered the suitable ones.
